Terms of Service

1. Acceptance of Terms

By creating an account or using DalabNet ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, you must not use the Platform.

2. Account Registration

• You must be at least 18 years old to create an account.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must not create multiple accounts or share your account with others.
• You are responsible for all activity that occurs under your account.

3. Marketplace Rules

• Sellers must provide accurate and truthful product descriptions, images, and pricing.
• All products must comply with Somali laws and applicable international regulations.
• Prohibited items include: illegal goods, counterfeit products, weapons, harmful substances, stolen property, and any items restricted by law.
• Prices must be listed in USD and reflect the actual cost of the product.
• Sellers must fulfill orders promptly and communicate any delays to the buyer.
• Buyers must inspect products upon delivery and report any issues within 48 hours.

4. Communication Rules

All buyer-seller communications must occur through DalabNet's built-in messaging system. Specifically:

• Sharing external contact information is strictly prohibited. This includes phone numbers, WhatsApp, Telegram, Instagram, Facebook, or any other means intended to conduct transactions outside DalabNet.
• DalabNet reserves the right to suspend or permanently ban accounts that attempt to bypass the Platform's communication system.
• Messages may be reviewed in cases of reported disputes, fraud, or abuse.
• Users must not send spam, threats, harassment, or offensive content through the messaging system.

5. Identity Verification (KYC)

• All merchant applicants must complete identity verification (KYC) before their store is approved.
• KYC requires submitting a government-issued ID and completing a face verification process.
• KYC data is handled in accordance with our Privacy Policy.
• Providing false or fraudulent identity documents will result in immediate account termination and may be reported to authorities.
• DalabNet reserves the right to request additional verification at any time.

6. Payments

• Payments are processed through mobile money services including EVC Plus, Zaad, and E-Dahab.
• Buyers must provide valid SMS proof of payment when confirming orders.
• All payments related to Platform transactions must be made through approved methods within DalabNet.
• DalabNet is not responsible for payment disputes between users and mobile money providers.
• Attempting to make payments outside the Platform for orders initiated on DalabNet is a violation of these terms.

7. Fraud Prevention and Safety

• DalabNet provides a marketplace to connect buyers and sellers and implements identity verification to promote trust.
• However, DalabNet cannot guarantee that all transactions are risk-free. Users are responsible for exercising due diligence.
• Users must follow DalabNet's safety guidelines, including: using only Platform messaging, verifying product details before purchase, and reporting suspicious activity.
• All conversations and payments should be conducted through DalabNet's approved channels whenever available.
• DalabNet actively monitors for suspicious behavior and cooperates with authorities when necessary.

8. Merchant Accounts

• Merchant applications are reviewed by the DalabNet team. Approval is at DalabNet's sole discretion.
• Merchants must maintain accurate store information and respond to customer inquiries promptly.
• Merchants are responsible for the quality, authenticity, and legality of their products.
• DalabNet reserves the right to suspend or terminate merchant accounts for violations of these terms.

9. User Content

• Users retain ownership of content they upload (product images, reviews, etc.).
• By uploading content, you grant DalabNet a non-exclusive, royalty-free license to display and distribute that content on the Platform.
• DalabNet may remove content that violates these terms, applicable laws, or community standards.
• You must not upload content that infringes on intellectual property rights of others.

10. Account Suspension and Termination

• DalabNet may temporarily suspend or permanently ban accounts that violate these terms.
• Grounds for suspension include: fraud, sharing external contact details, selling prohibited items, harassment, creating fake accounts, and any other conduct harmful to the Platform or its users.
• Suspended users may appeal by contacting support. Decisions on appeals are final.
• You may delete your account at any time. Certain data may be retained as described in our Privacy Policy.

11. Limitation of Liability

DalabNet operates as a marketplace platform connecting buyers and sellers. We are not a party to transactions between users. We are not responsible for the quality, safety, legality, or delivery of products. DalabNet's total liability to you shall not exceed the amount you paid to DalabNet (if any) in the 12 months preceding the claim.

12. Dispute Resolution

In case of disputes between buyers and sellers, DalabNet may mediate at its discretion but is not obligated to resolve disputes. Users are encouraged to communicate through Platform messaging and attempt to resolve issues amicably. DalabNet's decision in any mediation is advisory and non-binding unless otherwise stated.

13. Changes to Terms

DalabNet reserves the right to modify these Terms at any time. Significant changes will be communicated via Platform notifications or email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
